1. Introduction

These Terms & Conditions (“Terms”) govern your use of the PixelTight website (https://www.pixeltight.com) (“Site”) and services provided by PixelTight (“we”, “us”, “our”). By accessing or using our Site, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use our Site.

2. Use of the Site

You may use the Site only in compliance with these Terms and all applicable laws, rules, and regulations.
You agree not to use the Site for any unlawful purpose or in any manner that could damage, disable, or otherwise impair the Site or interfere with anyone else’s use of the Site.
We reserve the right to refuse service, terminate accounts, or block access to the Site at our discretion.

3. Account Registration

To access certain features of the Site (e.g., register or login), you may be required to create an account. You agree to provide accurate and complete information during registration and to keep your credentials secure and up to date.
You are responsible for all activities that occur under your account and for keeping your password confidential.

4. Services / Conversions

The Site provides services such as image conversion, compression and other related tools (“Services”). You acknowledge that the results may depend on the quality of the original files, the format chosen, your device and internet connection.
We do not guarantee that the Services will be uninterrupted, error-free or meeting any particular performance or accuracy standard.
You are responsible for maintaining backup copies of your uploaded files and output files. We may remove or delete files after a certain period or under our retention policies.

5. Intellectual Property

All content, features, and functionality on the Site (including but not limited to text, graphics, logos, icons, images, software) are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.
You may use the Services for your personal or internal business use only. You may not reproduce, distribute, modify, create derivative works of, publicly display, perform, republish, download, store or transmit any of the material from the Site except as permitted by us.
If you upload files, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, store, process, and deliver those files in connection with providing the Services. We will not use your files for other purposes without your consent.

6. User Content

“User Content” means any content you upload, submit or post to the Site. You retain ownership of your User Content but grant us the license described above.
You represent and warrant that you own or have the necessary rights to the User Content and that the User Content does not infringe any third-party rights, is not unlawful, obscene, defamatory, or otherwise objectionable.
We reserve the right (but not the obligation) to monitor, remove or refuse any User Content that breaches these Terms or is otherwise objectionable.

7. Disclaimer of Warranties

The Site and Services are provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, express or implied.
We expressly disclaim any warranty that the Site or Services will be uninterrupted, error-free, secure or free from viruses or other harmful components.
We do not warrant that any results obtained from use of the Services will be accurate or reliable.

8. Limitation of Liability

To the maximum extent permitted by applicable law, in no event will PixelTight, its affiliates, officers, directors, employees, agents or licensors be liable for any indirect, incidental, special, punitive or consequential damages whatsoever, including but not limited to loss of profits, data, use, goodwill or other intangible losses arising out of or related to your use of the Site or Services.
Our total aggregate liability for all claims arising out of or related to your use of the Site or Services will not exceed the amount you paid (if any) to us during the prior 12 months, or USD 1.00 if you paid nothing.

9. Indemnification

You agree to defend, indemnify, and hold harmless PixelTight, its officers, directors, employees, agents and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including attorney’s fees) arising from:

your use of and access to the Site;
your violation of these Terms;
your violation of any third-party right (including intellectual-property rights, privacy rights, publicity rights, etc.);
your User Content or your use of the Site in a way not authorized by us.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Bangladesh (or your jurisdiction of choice). You agree that any dispute arising out of or relating to these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts located in Dhaka, Bangladesh (or your jurisdiction selection).

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will post the updated Terms on this page and update the “Last updated” date. Your continued use of the Site after changes constitutes your acceptance of the new Terms.

12. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

13. Entire Agreement

These Terms (together with any additional policies referenced herein) constitute the entire agreement between you and PixelTight regarding your use of the Site and supersede any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us.
